3. Quotations and Estimates

4. Payment Terms

Final payment is due upon practical completion of the works, subject to any agreed retention periods.

We accept payment by bank transfer, cheque, or cash. Credit card payments may incur a processing fee.

Late payments may incur interest charges at the rate of 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
5. Project Timeline and Delays

Project timelines provided in quotations are estimates based on normal working conditions and are not guaranteed.

We will not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to: adverse weather conditions, delays in obtaining permits or approvals, site access restrictions, supply chain disruptions, or changes requested by the client.

We will endeavour to notify you promptly of any anticipated delays and work with you to minimise their impact.
6. Changes to Scope of Work

Any changes to the agreed scope of work must be requested in writing and will be subject to a written variation order.

Additional works requested outside the original contract will be priced separately and require your written approval before commencement.

We reserve the right to refuse changes that would compromise safety, structural integrity, or compliance with building regulations.
7. Health and Safety

Thane Construction is committed to maintaining the highest standards of health and safety on all projects, in compliance with the Health and Safety at Work etc. Act 1974 and related regulations.

Site-specific risk assessments and method statements will be provided where required.

Clients and their representatives must comply with all site safety instructions and wear appropriate personal protective equipment (PPE) when visiting active construction sites.

We reserve the right to suspend works if unsafe conditions are identified that cannot be reasonably mitigated.
8. Building Regulations and Compliance

All construction work will be carried out in compliance with current Building Regulations, British Standards, and relevant Eurocodes.

It is the client's responsibility to obtain any necessary planning permission, building control approval, or party wall agreements before work commences, unless otherwise agreed in writing.

We will provide documentation and certificates as required by building control and warranty providers (e.g., NHBC, Premier Guarantee).
9. Warranties and Guarantees

Thane Construction provides a 12-month workmanship warranty on all completed projects, covering defects arising from faulty workmanship or materials.

Structural warranties (e.g., NHBC Buildmark, Premier Guarantee) may be available for new build and major renovation projects, subject to separate terms and premiums.

Manufacturer warranties on materials and products remain with the respective manufacturers and are subject to their terms and conditions.

Warranty claims must be reported in writing within the warranty period. We reserve the right to inspect reported defects before undertaking remedial works.
10. Limitation of Liability

Our total liability to you for any loss or damage arising from our services shall not exceed the total contract value or £1,000,000 (whichever is lower), except where liability cannot be limited by law.

We will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of reputation.

We will not be liable for defects or damage caused by client interference, third-party works, normal wear and tear, or failure to follow maintenance instructions.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Cancellation and Termination

Either party may terminate the contract with written notice if the other party materially breaches the contract and fails to remedy the breach within 14 days of receiving written notice.

If you cancel the contract after work has commenced, you will be liable for all costs incurred up to the date of cancellation, including materials ordered and preparatory works.

We reserve the right to suspend or terminate works if payment is not received in accordance with the agreed payment schedule.
12. Intellectual Property
